How much money do I need to invest in the United States to be eligible for a visa?
There are several different types of investor visa. For example, if you choose to apply for an EB-5 visa, you must invest between $800,000 and $1,050,000. Investments in “high unemployment” or “rural” areas are eligible for the lower end of this range, while investments in other locations must reach the higher amount.
When I apply for an investor visa through a US business immigration attorney, Is my investment guaranteed?
No, your investment is not guaranteed. Part of the requirements for your investor visa is that the applicant’s American investment must be “at risk.” That means you have no guarantee that your investment will be repaid. If there is no risk of loss, then your investment usually doesn’t qualify for an investor visa.
How long is the processing time for a business visa?
Even with the best business immigration law firms, a variety of factors can influence your visa wait time. For example, different consulates and embassies are busier than others—even within the same country. Your case could take anywhere from a couple weeks to a few months. File early, and choose experienced business immigration attorneys for quicker results.
Will my family and children also be covered with my business visa?
In many common situations, your family will be able to join you in the United States. For example, investors immigrating on E-2 visas can bring their spouse and children on the same E-2 visa. In another example, H-1B visa holders can apply to bring their spouse and children on separate H-4 visas.
What’s the difference between temporary and permanent work visas?
These are the two main categories of US work visas. Temporary work visas allow you to live and work in the US short term—two of the most common are H-1B and L visas. Permanent work visas like the EB visa group allow for permanent residence. In some situations, temporary work visa holders may later become permanent residents, as well.
What are the requirements for getting an H-1B visa?
There are several requirements for obtaining an H-1B visa. These include receiving a job offer from an American employer for a position that requires specialized knowledge, possessing a bachelor’s degree or equivalent, and your employer proving that there are no qualified US applicants for your position.
What are the requirements for getting an L-1 visa with business immigration lawyers?
L-1 visas allow internal company transfers of foreign employees of US companies from foreign locations to domestic locations within the US. Your company must have been in business for at least one year, you must have been employed continuously for at least 12 months, and the process ends with consular processing abroad before receiving your visa.
What are the odds that my case is successful when I pick the right immigration business lawyer?
It’s not possible for a business immigration lawyer to tell you whether or not your case will be successful, especially before your consultation. Some of the most frequent issues that could cause problems with your application are immigration violations like illegal entry and visa overstays, or accidentally giving incorrect information on your application.
